Georgia’s limited medical cannabis program remains unworkable, but Georgians can still legally purchase and use CBD oil that’s derived from hemp.
Despite that Georgia’s medical marijuana program remains inoperable, roughly 1,300 Georgian patients have registered for medical cannabis with the state. Since 2015, Georgia’s implemented a medical marijuana law that allows people who suffer from serious conditions like cancer, Parkinson’s disease, and sickle cell disease to possess up to 20 ounces of cannabidiol (CBD) oil that contains no more than 5 percent THC, the chemical compound that causes a high.
Georgia’s medicinal cannabis law allows patients diagnosed with amyotrophic lateral sclerosis (ALS), cancer, Crohn’s disease, mitochondrial disease, multiple sclerosis, Parkinson’s disease, seizure disorders, and sickle cell disease to obtain a doctor’s recommendation for low-THC oil. About half of the patients registered with Georgia’s medicinal cannabis program are listed as having a seizure disorder, Georgia Health News reports. Around 25 percent of the registered patients are children, and another 33 percent are aged 50 or older.
The problem, however, is that as of now there’s nowhere for patients to obtain the low-THC marijuana oil. In-state cultivation, processing or sale of medical marijuana doesn’t exist, and while patients can acquire it from other states with medical marijuana laws, carrying the cannabis across state lines into Georgia is illegal. More than 70 percent of Georgia voters want the state’s program to be expanded to apply to more conditions and to implement in-state cultivation, according to a recent poll.
While Rep. Allen Peake (R-Macon) has already introduced a bill that would establish in-state cultivation and has urged the state to expand the program’s list of qualifying conditions, the people of Georgia will actually receive very little added benefit if the state’s limited medicinal cannabis program becomes operable. CBD oil that’s extracted from hemp, however, is legal to purchase, ship and consume in all 50 U.S. states, including Georgia. Like marijuana-derived cannabis oil, CBD hemp oil contains trace to no THC. It’s legal and accessible to anyone in Georgia, without a recommendation from a physician or state authorization.
CBD is one of the more than 85 cannabinoids found in both marijuana and hemp. Thousands of studies have been done on CBD and anyone interested in the cannabinoid’s effects are encouraged to examine that research on their own.
Georgia House Speaker David Ralston has said he supports a more comprehensive medical marijuana law for Georgia. A medical marijuana bill has already been prefiled by Republican lawmakers and if passed, it would replace Georgia’s limited CBD program. Until that time, those in Georgia can still access CBD derived from hemp.
