CBD Available in Maryland, Even as State’s Medical Marijuana Program Stalls

Cannabidiol (CBD) derived from hemp is legal and available to everyone in all 50 U.S. states, including Maryland, regardless if a state has an operational medical marijuana or adult use program.

Maryland’s medical cannabis commission has been hampered by pending legislation and legal battles since state lawmakers passed medical cannabis legislation in 2014. After a more than 2-year delay, the Natalie M. LaPrade Maryland Medical Cannabis Commission has said it expects to have medical cannabis available to patients sometime this summer. However, the patient registry has yet to open, and as The Cannabist reports, residents are concerned that one of the slowest medical marijuana program rollouts could get delayed even further.

The Maryland Medical Cannabis Commission was initially overwhelmed with an onslaught of applications from businesses interested in growing, processing and dispensing the medical cannabis. After a lengthy process, the commission pre-approved a selection of 30 growers and processors last August, but was instantly accused of not following a state mandate requiring a racially-diverse group of business owners and had to pause to evaluate whether it failed to follow the law.

Two emergency bills have been introduced by the Legislative Black Caucus to address the lack of ownership diversity. To examine whether discrimination does exist in the medical cannabis industry the state would conduct a study and the 15-member commission would be overhauled to reflect the diverse makeup of Maryland. State lawmakers are currently considering the bills, but according to Sarah Hoyt, director of government affairs for the commission, any changes at this point would “substantially delay the availability of medical cannabis to qualifying patients,” by as much as two years.[/vc_column_text][/vc_column][/vc_row][vc_row][vc_column][vc_single_image image=”17466″ img_size=”1200×250″ onclick=”custom_link” img_link_target=”_blank” link=”https://www.medicalmarijuanainc.com/what-is-cbd-hemp-oil/”][/vc_column][/vc_row][vc_row][vc_column][vc_column_text]Once Maryland’s medical marijuana program is implemented, qualified patients that have obtained a doctor’s recommendation will be legally allowed to possess up to 120 grams of non-smokable marijuana products, including extracts, lotions, ointments, tinctures, and other forms of cannabis that can be vaporized.

Because marijuana and its extracts, including the psychoactive compound tetrahydrocannabinol (THC), are classified as Schedule I substances under the federal Controlled Substances Act, patients in the U.S. only have legal access to medical marijuana if they reside in one of the 28 states that have passed laws establishing state-regulated programs. Even the non-psychoactive compound cannabidiol (CBD), when derived from marijuana, is subject to federal law.

CBD that is derived from the seeds and stalk of imported hemp, however, is excluded from the federal law.
